TERMS AND CONDITIONS
1. Pricing and Payment:
Total Estimated Cost due on final fitting of gown Payment must be completed before final garment release, unless otherwise agreed in writing.
2. Expenses:
If the Client’s event is cancelled or rescheduled, or if the Client chooses to discontinue alterations for any reason, the Client remains responsible for payment of all work completed up to that point.
3. Termination of Contract:
This Contract shall remain in effect until the garment is collected, unless terminated earlier by either party. In the event of termination prior to project completion, the Client agrees to pay all fees and expenses incurred through the effective date of termination.
4. Garment Policies:
Garments will not leave the studio once alterations have begun. The Client must try on and fully inspect the garment at the final fitting; leaving the studio constitutes acceptance of the work as complete and satisfactory. Alterations are based on measurements taken at the first fitting, and Posy of Threads is not responsible for fit issues resulting from changes after that fitting. Any alterations requested after the garment leaves the studio will be treated as new work and charged accordingly. Posy of Threads is not responsible for the garment after pickup, including damage, stains, or dry cleaning. Garments not collected within 30 days of the final appointment may be considered abandoned unless alternative arrangements are made. The Client agrees to review the final product, remain reasonably available for questions, and provide timely feedback and decisions.
5. Warranty:
No refunds will be issued for work completed or services provided under this contract, except as required by consumer guarantees under Australian Consumer Law or as otherwise permitted by law. All alterations are carried out to the best of our ability. Please note that some garments may have inherent weaknesses. We are not liable for any damage or breakage resulting from improper handling, wear, or care of the garment. This includes, but is not limited to, wedding gown bustles that are damaged due to being stood on, incorrect lifting, or inadequate care prior to sitting.
6. Faults:
In the event of a legitimate fault, the Client must notify Posy of Threads directly, at which time the Faults Procedure will be initiated. The initial step of this procedure is a formal inspection of the alleged fault.In accordance with Australian Consumer Law, Posy of Threads will, in the first instance, offer to remedy any confirmed fault by way of repair. The Client is required to accept this repair option as provided for under Australian Consumer Law. A refund will only be considered where the item is deemed irreparable following inspection and, where permitted by law, will be issued at the sole discretion of Posy of Threads.
7. In Case of Emergency:
The Client agrees that Posy of Threads shall not be responsible for any loss or damages arising from unforeseen events, including but not limited to fire, flood, vehicle accidents, or break-ins.
8. Measurement Disclaimer:
All measurements recorded on this form are taken on the specified date and reflect the Client’s body measurements at that time only. Posy of Threads accepts no liability for incorrect sizing resulting from subsequent body fluctuations, variations caused by garments worn during the measurement process, or discrepancies between the Client’s measurements and manufacturer sizing standards. Where there is any uncertainty regarding sizing, the Client is advised to contact Posy of Threads for guidance. It is acknowledged that most online retailers select the closest available size rather than an exact measurement match. For custom-made garments, the Client is responsible for ensuring that appropriate ease is added where required. If the client has a discrepancies with the fitting of the gown, Posy of threads highly recommends the client contact place of purchase of gown and request measurements and taken on day of purchase. Posy of Threads does not take any liability or responsibility for incorrect measurement from place of purchase.
9. Invoices:
The Client agrees to pay all invoices by the due date(s) on collection of the completed gown. Any unpaid or overdue invoices may result in the suspension or termination of the Project, and the goods will stay as property of Posy of Threads until payment is made. Should the scope of work change for any reason, including but not limited to body weight fluctuation, pregnancy, surgery, changes to footwear or undergarments, or requests for additional alterations, a revised quote will be issued for the additional work required or if verbal consent is given during subsequent fitting for more alterations, this amount will be added to the final invoice.
10. Payment:
Posy of Threads accepts cash, bank transfer and EFPOS (surcharge will apply)
